SNYDER - The Texas Supreme Court opened the door for Kinder Morgan to again request that a lawsuit brought against the company by four taxing entities be dismissed. It also ordered four Scurry County taxing entities to pay the company’s expenses related to its appeal of the original district court ruling denying the motion. The court issued a 23-page opinion April 30 reversing the 11th Court of Appeals opinion that had upheld District Judge Ernie Armstrong’s ruling that the motion to dismiss had been filed too late, and remanded the case back to 132nd District Court.
